1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Player," "You," or "Your") and phkai ("Company," "We," "Us," or "Our"), the operator of the website phkai.cam and associated mobile applications (collectively, the "Platform"). By registering an account, accessing the Platform, placing wagers, or using any services provided by phkai, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Responsible Gaming Policy, and any other rules, policies, or guidelines posted on the Platform.

If you do not agree with any provision of these Terms, you must immediately cease using the Platform and refrain from creating an account. Continued use of phkai after amendments to these Terms constitutes acceptance of the modified Terms. We reserve the right to modify, amend, or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes.

2. Eligibility Requirements

To use the phkai Platform and participate in online gambling activities, you must meet all of the following eligibility requirements:

• Age Requirement: You must be at least twenty-one (21) years of age or older. phkai strictly enforces age verification procedures in compliance with Philippine Amusement and Gaming Corporation (PAGCOR) regulations and Philippine law. Any person under the age of 21 is prohibited from registering an account, depositing funds, or participating in any gaming activities on the Platform.
• Legal Capacity: You must have the legal capacity to enter into binding contracts under Philippine law. This means you must not be subject to any legal disability, mental incapacity, or guardianship that would prevent you from understanding and agreeing to these Terms.
• Jurisdiction: You must be physically located in the Republic of the Philippines when accessing the Platform and placing wagers. Online gambling from outside Philippine territory is strictly prohibited and may result in immediate account suspension and forfeiture of funds.
• Voluntary Participation: You must be participating in gambling activities of your own free will and not under duress, coercion, or undue influence from any third party.
• No Prohibited Persons: You must not be included on any self-exclusion list, banned person registry, or other exclusion database maintained by phkai, PAGCOR, or any other regulatory authority.
• Single Account: You may only register and maintain one (1) account with phkai. Creation of multiple accounts is strictly prohibited and may result in closure of all accounts and forfeiture of balances.

3. Account Registration and Security

3.1 Account Creation

To access phkai's gaming services, you must register for an account by providing accurate, complete, and current information as prompted by the registration form. This includes your full legal name, date of birth, valid Philippine mobile number, email address, residential address, and other information required for identity verification and regulatory compliance. You agree to maintain and promptly update this information to keep it accurate and complete.

3.2 Username and Password

During registration, you will create a unique username and password for your account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify phkai of any unauthorized use of your account or any other breach of security. phkai will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Identity Verification (KYC)

phkai implements comprehensive Know Your Customer (KYC) procedures in compliance with PAGCOR regulations and the Anti-Money Laundering Act (AMLA) of the Philippines. You may be required to submit government-issued identification documents (valid Philippine passport, driver's license, UMID, or national ID), proof of address (utility bill, bank statement, or government correspondence dated within the last three months), and photographic verification (selfie holding your ID). phkai reserves the right to request additional documentation at any time. Withdrawal requests may be delayed or denied until satisfactory verification is completed.

3.4 Account Restrictions

Each person may register only one account with phkai. Creating duplicate accounts, accounts using false information, or accounts registered on behalf of third parties is strictly prohibited. phkai employs sophisticated fraud detection systems to identify duplicate accounts through matching of personal details, IP addresses, device fingerprints, payment methods, and behavioral patterns. Discovery of duplicate accounts may result in closure of all related accounts and forfeiture of all funds and winnings.

4. Deposits and Withdrawals

4.1 Deposit Methods

phkai accepts deposits through various payment methods available to Philippine users, including but not limited to GCash, Maya (formerly PayMaya), bank transfers, online banking, over-the-counter payment centers, and cryptocurrency wallets (where available). All deposits must be made using payment methods registered in your own name. Third-party deposits are strictly prohibited as an anti-money laundering measure. Minimum and maximum deposit limits apply depending on the payment method selected and your account status.

4.2 Deposit Processing

Most deposits are processed instantly or within minutes, though processing times may vary depending on the payment method and third-party payment processor involved. phkai is not responsible for delays caused by payment providers, banks, or network issues beyond our control. Funds will be credited to your phkai account balance upon successful confirmation of payment receipt.

4.3 Withdrawal Procedures

You may request withdrawals of your available account balance at any time, subject to completion of identity verification (KYC) procedures and satisfaction of any applicable bonus wagering requirements. Withdrawals must be made to payment methods registered in your own name that match the payment methods used for deposits. This policy is implemented to prevent money laundering and protect against fraud.

4.4 Withdrawal Processing Times

phkai strives to process withdrawal requests as quickly as possible. Standard withdrawal processing times are as follows: GCash and Maya withdrawals typically complete within 5-30 minutes; bank transfers typically complete within 1-3 business days; cryptocurrency withdrawals typically complete within 1 hour depending on blockchain confirmation times. All withdrawal requests are subject to security review, which may extend processing times in some cases.

4.5 Fees and Charges

phkai does not charge fees for deposits or withdrawals. However, your payment provider, bank, or cryptocurrency network may impose transaction fees or currency conversion charges over which phkai has no control. You are responsible for any such third-party fees. Minimum withdrawal amounts may apply depending on the payment method selected.

5. Gaming Rules and Conduct

5.1 Fair Play Obligations

All users of phkai must engage in fair play and comply with the rules of each game. You agree not to use any automated betting software, bots, artificial intelligence, or other mechanical or electronic devices that provide an unfair advantage. You agree not to collude with other players, share information, or engage in any form of cheating or fraudulent behavior. You agree not to exploit software bugs, glitches, or errors for financial gain. Discovery of any prohibited activity may result in immediate account termination and forfeiture of funds.

5.2 Game Results

All games available on phkai use certified Random Number Generators (RNG) or live dealer mechanisms that ensure fair and random outcomes. Game results are final and binding once the game round is completed and results are displayed. phkai reserves the right to void any game results affected by technical malfunctions, communication failures, or errors in game software. In the event of a game malfunction, affected wagers will be refunded to the player's account balance.

5.3 Betting Limits

phkai implements minimum and maximum betting limits on all games, which may vary depending on the game type, your account status, and regulatory requirements. We reserve the right to modify betting limits at any time and to impose individual betting limits on specific accounts based on risk management considerations or responsible gaming concerns.

5.4 Prohibited Activities

The following activities are strictly prohibited on the phkai Platform and constitute grounds for immediate account termination:

• Using the Platform for any purpose other than personal entertainment and gaming
• Commercial or professional gambling activities (arbitrage betting, matched betting, bonus abuse)
• Money laundering or using the Platform to transfer funds between parties
• Reverse engineering, decompiling, or attempting to discover source code of Platform software
• Distributing viruses, malware, or other harmful code
• Attempting to gain unauthorized access to other user accounts or Platform systems
• Harassing, threatening, or abusing phkai staff or other users
• Creating multiple accounts or using nominee accounts to circumvent restrictions

6. Bonuses and Promotions

phkai offers various bonuses, promotions, and loyalty rewards to eligible players from time to time. All bonuses and promotions are subject to specific terms and conditions ("Bonus Terms") that will be clearly communicated at the time the offer is made. These Bonus Terms form part of these overall Terms and Conditions. Key provisions applicable to all bonuses include:

• Bonuses are voluntary and may be declined if you prefer to play with real money only
• Wagering requirements specify how many times bonus funds must be wagered before conversion to withdrawable cash
• Maximum bet limits may apply when playing with bonus funds to prevent bonus abuse
• Time limits specify the period during which wagering requirements must be met

Abuse of bonuses or promotions, including but not limited to creating multiple accounts to claim multiple bonuses, colluding with other players, or employing betting strategies designed solely to meet wagering requirements while minimizing risk, is strictly prohibited and will result in forfeiture of bonuses and associated winnings, and may result in account termination.

7. Intellectual Property Rights

All content, materials, software, graphics, text, logos, designs, data compilations, and other intellectual property available on or through the phkai Platform ("Content") are owned by phkai or its licensors and are protected by Philippine and international copyright, trademark, and other intellectual property laws. The phkai name, logo, and related marks are registered trademarks owned by phkai and may not be used without written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform strictly for personal, non-commercial entertainment purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content from the Platform except as permitted by these Terms or as expressly authorized in writing by phkai.

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any software used to operate the Platform. You agree not to use any automated systems or software to extract data from the Platform ("scraping"). Unauthorized use of the Platform or its Content may violate intellectual property laws and these Terms, and may result in civil liability and criminal prosecution.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHKAI, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, THE "PHKAI PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Unauthorized access, use, or alteration of your transmissions or content
• Technical malfunctions, errors, or interruptions in Platform services
• Gambling losses incurred while using the Platform

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE PHKAI PARTIES TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE DEPOSITED INTO YOUR PHKAI ACCOUNT IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, the phkai Parties' liability will be limited to the fullest extent permitted by applicable law.

9. Dispute Resolution and Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved through the following procedures:

9.1 Internal Complaint Procedures

If you have any complaint or dispute regarding the Platform or services provided by phkai, you should first contact our Customer Support team through the contact channels provided on the Platform (live chat, email, or phone). We will make reasonable efforts to resolve complaints promptly and fairly within a reasonable timeframe, typically within 14 business days.

9.2 Arbitration

If a dispute cannot be resolved through internal complaint procedures, either party may initiate binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in Metro Manila, Philippines. The arbitration shall be conducted in English unless otherwise agreed by the parties. The decision of the arbitrator shall be final and binding on both parties.

9.3 Regulatory Complaints

You may also submit complaints regarding phkai's operations to the Philippine Amusement and Gaming Corporation (PAGCOR), the regulatory authority overseeing licensed online gambling operators in the Philippines. 9.4 Jurisdiction

To the extent that arbitration is not required or applicable, you agree that any legal action arising out of or relating to these Terms or the Platform shall be filed exclusively in the courts of Metro Manila, Philippines, and you consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

10. Account Closure and Termination

10.1 Voluntary Account Closure

You may close your phkai account at any time by contacting Customer Support and requesting account closure. Before closure, you must withdraw all available funds from your account balance, subject to satisfaction of any applicable wagering requirements. Once your account is closed, you will no longer have access to the Platform or any account information.

10.2 Involuntary Account Suspension or Termination

phkai reserves the right to suspend or terminate your account immediately, with or without notice, for any reason, including but not limited to: (a) breach of these Terms; (b) provision of false or misleading information; (c) fraudulent, suspicious, or illegal activity; (d) abusive behavior toward staff or other users; (e) failure to complete identity verification when requested; (f) account inactivity for an extended period; (g) at the request of regulatory authorities; or (h) at our sole discretion for any other legitimate business reason.

10.3 Consequences of Termination

Upon termination of your account for breach of these Terms, you forfeit any right to your account balance, including deposits, winnings, and bonus funds. phkai reserves the right to retain any funds in accounts terminated for fraudulent or illegal activity and to report such activity to appropriate law enforcement or regulatory authorities. For account closures not involving breach of Terms, you will be permitted to withdraw your available balance following standard withdrawal procedures.

10.4 Self-Exclusion

If you wish to temporarily or permanently exclude yourself from gambling activities due to problem gambling concerns, you may request self-exclusion by contacting our Responsible Gaming team. Self-exclusion periods can range from 6 months to permanent exclusion. During the self-exclusion period, you will be unable to access your account or create new accounts, and phkai will take reasonable measures to prevent you from accessing the Platform. By using the Platform, you consent to the collection and use of your personal information as described in our Privacy Policy. This includes sharing your information with third-party service providers who assist in operating the Platform (payment processors, identity verification services, fraud prevention systems), with regulatory authorities as required by law, and with law enforcement agencies when legally compelled.

phkai implements industry-standard security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security of your information.

12. Miscellaneous Provisions

12.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Responsible Gaming Policy, and any other policies or guidelines referenced herein, constitute the entire agreement between you and phkai regarding your use of the Platform, and supersede all prior or contemporaneous understandings, agreements, representations, or warranties, whether written or oral.

12.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

12.3 Waiver

No waiver by phkai of any term or condition of these Terms shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by phkai to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of phkai. phkai may assign, transfer, or delegate its rights and obligations under these Terms at any time without restriction and without notice to you.

12.5 Force Majeure

phkai shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, government actions, internet or telecommunications failures, power outages, or natural disasters.

12.6 Language

These Terms are written in English. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency between versions.
